Class actions prompted by lash product spur additional legal headache for cosmetics direct seller

Rodan + Fields’ insurance carrier has filed a complaint against the skincare brand just as the direct seller navigates class actions related to one of its products. Ironshore Specialty Insurance Co., a Liberty Mutual subsidiary, filed the complaint in a California federal court and maintains that it should be exempt from paying Rodan + Fields’ legal defense or any claims arising from the class action cases currently being deliberated in state and federal courts.

Blake Schroeder, Medical Marijuana 

Medical Marijuana Inc., parent company of Kannaway, has appointed Blake Schroeder as CEO and president. Schroeder will replace Dr. Stuart Titus, who is semi-retiring. Schroeder joined the company in 2016 and was formerly CEO of Kannaway. He also has  worked for Forevergreen and MonaVie.

The Federal Trade Commission (FTC) announced on June 14 a review of the Business Opportunity Rule by the end of the year. The Rule was first proposed in 2006 and was finalized with amendments in 2012 after direct selling companies and the Direct Selling Association (DSA) vigorously argued for, and ultimately received, a generalized exclusion from the Rule.

In a relationship business, is it really necessary to have an app—is that what distributors expect? 

According to a Mary Meeker report, Americans are spending 5.6 hours a day on the internet, and 3.6 hours of that is on their mobile devices. With eMarketer asserting that 88 percent of mobile device time is spent within apps rather than within a browser, it makes sense for direct sales companies to invest in app technology. 

To develop a successful app, executives need to ask themselves three questions, according to Damian Mobley, MONAT’s executive director of technology. “First, will the app serve a purpose that isn’t already being satisfactorily met; that is, are you replacing something inferior? Next, do the people want the functions you’re planning to offer? And finally, can you roll it out effectively?”

FTC Looks to Expand Civil Penalty Arsenal in Wake of AMG Loss

With the FTC’s fight on the Hill for new 13(b) authority ongoing, two recent enforcement actions signal that the Commission plans to use its civil penalty authority in novel ways with significant implications for the direct selling industry.

In the wake of the Supreme Court’s unanimous decision in favor of AMG Capital Management—which stated that the FTC lacks authority to obtain monetary redress under Section 13(b) of the FTC Act—then Acting Chair Rebecca Slaughter vowed to lobby Congress in response. 

Her goal was to “restore and strengthen the powers of the agency” and consider new ways to obtain money from companies through enforcement. Two months after the AMG decision, the
FTC continues to make good on those promises.
